Drainage pipe filled with bitumen outside 27 Magdalen Avenue

Having moved back into my property, I was concerned about the amount of damp in my basement. i also noticed that the drainage pipe which took the water from the down pipe had been cut and filled with bitumen. this has resulted in the water going back into the property and not running away, into the kerb and the drainage system. I have had an builder investigate this issue and they have stated a correlation between the damp (see photos) and the blocked soak away. As the owner of the house, why was I not informed regarding this? as it has had a significant impact on my house. The photos attached shows the pipe cut and filled and one which is in its original state.
