Issues with drainage pipe under pavement

I have a problem with the guttering outflow from my house to the nearby drain. The guttering at the top of my house serves 3 houses and the down pipe is by my front door. The guttering is under the pavement. Unfortunately, the outlet pipe within the kerb is frequently squashed by juggernauts. I have paid to have the outlet opened but within days it is squashed again. This results in rain water backing up and coming into my house when it rains heavily. I have paid for a builder to fit a new weatherboard to no avail. I have lived here for 21 years and the quality of the pavement is poor. Short of installing a metal spike, the only solution I can think of is to have a gully with grid in the pavement and kerb stone. Is this something I can ask a builder to do or is it the council’s responsibility?
