Overhanging Tree into private property

There is currently a dangerously overhanging tree into the back garden of 15 Lambourn Road from Breaches Lane which leads onto Cherwell Road. It is staining our patio with berries and shedding it's leaves consistently which is fouling our patio.

We had a tree surgeon come round. He thought it's an Ash tree in the lane and often they produce many seeds when they are in distress. He wondered if it had Ash Die back disease.
