Tree overhanging 12 Rennie Close

Sent to Bath and North East Somerset Council less than a minute later. Council ref: 5195702.

Overgrown tree overhanging dangerously our garden, over the year and with bad weather large branches are coming down and I am worried for my family safety. It has tree preservation on it although it is not marked on the map. 3 words location: paying. form. from.

  • Thank you for your report. The trees at this location were routinely inspected in 2020 and found to be in good health. A note has been made on the tree's record of your report and the inspector will take this into account when inspecting the trees at this site which will be included in next year's programme. There is information that may be helpful on the council's website but please note the information below as this site is within the conservation area of Bath:

    You have a common law right to remove overhanging branches from trees encroaching onto your property.

    However, you can only cut parts of the tree where they cross the boundary onto your property. You do not have the legal right to remove any part of a tree that does not overhang your property.

    If you want to remove overhanging branches from trees protected by a Tree Conservation order or in a Conservation Area, you need to give us 6 weeks notice using our planning portal.
