Hopton way, lansdown, opposite junction with battle walk

Reported via desktop in the Vegetation overhanging a road or pavement from private land or property category anonymously at 21:07, Saturday 29 June 2024

Sent to Bath and North East Somerset Council less than a minute later. Council ref: 6171425.

This large oak tree sits on private land previously owned by MoD and has become dangerous with substantial limbs and branches regularly falling onto the adjoining public footpath below. The footpath connects Granville Road (cul-de-sac) and Hopton Way, but is now obstructed by overhanging vegetation which prevents the passage of mothers with prams, young children on bicycles and scooters, and also by local mobility aid users.

  • A heavy section of this dangerous tree has suddenly cracked and the fallen limb is now dragging in the grassed area below. Fortuitously, it seems to have just missed the seating bench below and, on this occasion, did not fall onto either pedestrians and children using the adjoining public footpath, or into the path of vehicles passing by on Hopton Way.

  • It is now more than three weeks since I submitted this report. It refers to a highway safety issue. I am anticipating action by the Highway Authority under s154 Highways Act 1980. The only response received from BANES to date is that my report has been passed to the appropriate team for investigation, and then to yet another team !?

  • This report was first logged on 29 June 2024. Almost three months later, there has been no response to the matters raised, no further updates from BANES as the Highway Authority responsible, and the public footpath remains obstructed.
